Asbestos And Lead Testing Before A Teardown

What the survey looks for, who is allowed to sign it, and why the Air District needs ten business days before a machine touches the building.

Every demolition in the Bay Area starts the same way, and it is not with an excavator. It starts with a certified consultant walking the building, pulling samples of anything that could hold asbestos, and writing a survey that the Air District and the county both want to see before a permit is issued.

Legacy Demolition is a licensed local crew based in El Sobrante, working across Contra Costa and Alameda County with one fixed written number per job, permits and disposal included.

Why The Survey Comes First

Bay Area Air Quality Management District Regulation 11 Rule 2 requires notification for every demolition, whether or not asbestos turns up. The notification is built on a survey done by a Cal/OSHA certified asbestos consultant, and Contra Costa County lists Air District approval as one of the boxes that has to be ticked before a demolition permit is released. Skipping it does not save time. It stops the permit.

What A Survey Actually Samples

  • Roofing and siding. Old composition shingles, mastic and cement board panels are the most common positives on East Bay houses built before 1980.
  • Floor systems. Nine by nine vinyl tile, sheet vinyl backing and the black adhesive under both.
  • Insulation and ducting. Pipe wrap, furnace cement, duct tape at joints and loose fill in attics.
  • Wall finishes. Textured ceilings, joint compound and some plaster systems.
  • Exterior transitions. Window putty, stucco patches and the paper behind them.

The Ten Day Window Nobody Budgets For

The Air District asks for notification at least ten business days before the work starts. For residential buildings of four units or fewer there is a shorter notice option with an extra fee, but the ten day path is the one most projects use. Two calendar weeks sits between the survey result and the first day on site, and that is before the county has looked at the application.

The dates you enter are treated as confirmed, not as a rough window. If the start slips and nobody revises the job number, the job can end up out of compliance on paper while the site is still untouched. We track that date for our clients so the notification and the machine show up in the same week.

Lead Is A Separate Question

Lead paint is common in anything built before 1978 and it is regulated separately from asbestos. For a full teardown the material leaves as debris and the concern is dust control and worker protection rather than abatement of a surface that will keep existing. For a partial demolition or an interior strip out, painted surfaces that stay in place change the picture, and the rules for lead related construction work apply to the crew doing the cutting.

The practical answer on most of our jobs is the same either way. Wet the material down, keep the debris contained, and load directly rather than letting a pile sit and dry out in the wind. You can read how we handle the site itself on our residential demolition page.

How This Fits A Real Schedule

A typical East Bay house runs like this. Week one, the consultant surveys and the lab returns results. Week two, the notification goes in and the county application moves with the utility releases. Week three, the ten business days close out and the machine rolls in. Two to three days of demolition, a day of loading and grading, then the final inspection with capped utilities visible.

The survey cost is small next to the cost of finding friable material on day two with a crew standing around. It also feeds the recycling paperwork, since the county wants sixty five percent of nonhazardous debris diverted, and you cannot document diversion on material you were not allowed to touch. More on that in our guide to where demolition debris goes and what a commercial demolition adds on top.

The survey is not a formality. It is the document that lets everything else start moving.

Common Questions

Do I need a survey on a small detached garage?

Air District notification applies to demolition generally, so a detached structure is not automatically exempt. Confirm with the consultant before assuming it is.

Who is allowed to do the survey?

A Cal/OSHA certified asbestos consultant or certified site surveillance technician working under one. A general contractor cannot self certify the building.

What if the survey comes back positive?

Abatement happens before demolition, by a licensed abatement contractor, and the material leaves under its own manifest. The demolition schedule shifts by the length of that work.

Does the homeowner or the contractor file the notification?

Either can, but the party doing the demolition is the one named on the form and the one exposed if the dates are wrong. We file it for our clients.
